Healthcare facilities, medical professionals and patients
Medical liability in Italy is governed by Law no. 24/2017 (the Gelli-Bianco Law), which distinguishes the position of the healthcare facility from that of the individual professional, imposes mandatory insurance cover and requires an attempt at conciliation before court proceedings. The firm assists facilities and professionals in handling and defending compensation claims and, on a selective basis, patients and their families.
For healthcare facilities and professionals
Private clinics, nursing homes, care homes (RSA), outpatient and diagnostic centres, as well as doctors in private practice.
- handling of compensation claims and relations with the insurer;
- review of insurance policies and cover against statutory requirements;
- defence in preliminary technical assessments (ATP), mediation and court proceedings;
- recourse actions and relations between facilities and professionals;
- prevention: internal organisation, clinical risk management and 231 models, in coordination with our Organisation and 231 practice.
For patients and their families
Each case is first reviewed with a trusted forensic medical expert, to verify whether the harm, its causal link with the healthcare treatment and the amount of compensation justify taking action. Only after this assessment do we propose to proceed.
- preliminary forensic medical assessment;
- preliminary technical assessment with a view to conciliation, or mediation;
- action against the facility, the professional and the insurer.
In every engagement the firm checks for conflicts of interest with the facilities and professionals it assists.
Litigation. We directly handle every stage: conciliation, proceedings on the merits and appeals.
